Fiduciary Appointments

Personal Representative/ Executor

Named in your will.

As a named Personal Representative, we are legally responsible to manage a deceased person’s estate to distribute his or her assets according to their Last Will & Testament. We manage unfinished and ongoing affairs, by closing bank and financial accounts, selling real estate, businesses and other assets, and paying debts and taxes. We protect and maintain all tangible personal property and belongings to prepare for their distribution to heirs or beneficiaries.

Trustee & Successor Trustee

Named in your trust.

As a Trustee, we are responsible for carrying out the purposes of the trust which are described within the trust document. We manage the assets held by the trust and assume fiduciary responsibility for managing those assets.  We make tax filings for the trust and distribute the assets according to the terms of the trust. A Successor Trustee is a person who takes on the Trustee role when the Trustee no longer serves, usually when the grantor loses capacity or passes away. We serve as trustee or successor for revocable living trusts, irrevocable trusts, life insurance trusts, charitable and special needs trusts.

Designation of Healthcare Surrogate

Named in your advanced healthcare directive.

An Advance Healthcare Directive allows you to make your wishes known, including naming who will make healthcare decisions for you. As a healthcare agent, we gain access to information and communicate with care providers in a professional capacity. We advocate for you according to your wishes, gathering the facts to support your decision-making ahead of time. Taking the time to help you define your end-of-life care preferences helps us gain a clear understanding of the things that matter most to you.

Attorney-in-Fact

Named in your durable power of attorney.

A Durable Power of Attorney is a legal document that describes the authority assigned. The person creating the document, the principal, assigns an attorney-in-fact to act and make decisions on their behalf. A Durable Power of Attorney typically stays in effect when you lose capacity, and the agent can serve immediately, if necessary. An attorney-in-fact, has the legal authority to manage a person’s financial affairs pursuant to the instructions and guidelines written in their Power of Attorney document. This authority is over non-trust assets and ends on the passing of the principal.

Professional
Guardianship Services

When an individual is no longer able to manage their affairs safely and independently, the court may appoint a guardian. As a Licensed Professional Guardian, we serve in two key capacities:

Guardian of the Person: We coordinate medical and personal care, help determine the most appropriate residential setting, and ensure the individual’s well-being is prioritized at all times. We submit annual care plans and physician reports to the court to demonstrate ongoing oversight and support.

Guardian of the Property: We manage and protect the financial assets of individuals under our care. This includes inventorying assets, paying bills, managing investments prudently, and filing annual reports with the court. All financial decisions are made in the individual’s best interest and in accordance with court guidelines.
